Règlement grand-ducal du 8 avril 2020 portant dérogation à l’article L. 121-6 du Code du travail

Par dérogation à l’article L. 121-6, paragraphe 3, du Code du travail le délai de protection contre le licenciement de vingt-six semaines est prolongé d’une durée correspondant à la période située entre la date d’entrée en vigueur du présent règlement et la fin de l’état de crise telle que fixée par la loi du 24 mars 2020 portant prorogation de l’état de crise déclaré par le règlement grand-ducal du 18 mars 2020 portant introduction d’une série de mesures dans le cadre de la lutte contre le Covid-19. À partir du premier jour de la vingt-septième semaine de protection contre le licenciement l’employeur averti conformément au paragraphe 1er de l’article L. 121-6 du Code du travail ou en possession du certificat médical visé au paragraphe 2 du même article est autorisé, uniquement pour motifs graves, à notifier au salarié la résiliation de son contrat de travail, ou, le cas échéant, la convocation à l’entretien préalable visé à l’article L. 124-2 du Code du travail.
Le présent règlement entre en vigueur le jour de sa publication au Journal officiel du Grand-Duché de Luxembourg.
Notre ministre du Travail, de l’Emploi et de l’Économie sociale et solidaire est chargé de l’exécution des dispositions du présent règlement qui sera publié au Journal officiel du Grand-Duché de Luxembourg.
