Art. 1er. #art_1er applicable 2020-12-21
Par dérogation à l’article L. 121-6, paragraphe 1er, du Code du travail, le salarié incapable de travailler pour cause de mise en quarantaine ou en isolement est obligé, le jour même de l’empêchement, d’en avertir personnellement ou par personne interposée l’employeur ou le représentant de celui-ci.
Art. 2. #art_2 applicable 2020-12-21
Par dérogation à l’article L. 121-6, paragraphe 2, du même code, le salarié incapable de travailler pour cause de mise en quarantaine ou en isolement est obligé de soumettre à l’employeur, au plus tard le huitième jour de son absence, une ordonnance officielle de mise en quarantaine ou de mise en isolement émanant de l’autorité nationale compétente et servant de certificat d’incapacité de travail.

Par dérogation à l’article L. 121-6, paragraphe 3, alinéa 1er, du même code, l’employeur averti conformément à l’article L. 121-6, paragraphe 1er, du Code du travail, en possession du certificat médical visé à l’article L. 121-6, paragraphe 2, du Code du travail ou en possession d’une ordonnance officielle de mise en quarantaine ou de mise en isolement visée à l’article 2 n’est pas autorisé, même pour motif grave, à notifier au salarié la résiliation de son contrat de travail, ou, le cas échéant, la convocation à l’entretien préalable visé à l’article L. 124-2 du Code du travail pour une période de vingt-six semaines au plus à partir du jour de la survenance de l’incapacité de travail.

La présente loi entre en vigueur le jour de sa publication au Journal officiel du Grand-Duché de Luxembourg et reste applicable jusqu’au 30 juin 2022 inclus.
