    Art. 1er.Par dérogation aux articles 11, alinéa 2, et 12, alinéa 3, du Code de la sécurité sociale et à l’article L. 121-6, paragraphe 3, alinéa 2, première et deuxième phrases, du Code du travail, l’assurance maladie-maternité prend en charge l’indemnité pécuniaire de maladie visée à l’article 9, alinéas 1er et 2 du Code de la sécurité sociale due aux salariés et aux non-salariés pendant la période se situant entre le premier jour du mois de calendrier qui suit le 18 mars 2020 et le dernier jour du mois de calendrier au cours duquel prend fin l’état de crise, tel que déclaré par le règlement grand-ducal modifié du 18 mars 2020 portant introduction d’une série de mesures dans le cadre de la lutte contre le Covid-19 et prorogé par la loi du 24 mars 2020 portant prorogation de l’état de crise déclaré par le règlement grand-ducal du 18 mars 2020 portant introduction d’une série de mesures dans le cadre de la lutte contre le Covid-19.La prise en charge par l’assurance maladie-maternité de l’indemnité pécuniaire de maladie conformément à l’alinéa 1er s’applique sans préjudice de l’obligation pour l’employeur de veiller à ce que le salarié incapable de travailler soit indemnisé au niveau de l’intégralité du salaire et des autres avantages résultant de son contrat de travail jusqu’à la fin du mois de calendrier au cours duquel se situe le soixante-dix-septième jour d’incapacité de travail pendant une période de référence de dix-huit mois de calendrier successifs.
