    Article unique.Au livre II, titre VII, chapitre VII, du Code pénal, il est inséré un article 385ter nouveau qui prend la teneur suivante : « Art. 385ter.Le fait d’user de tout moyen afin d’apercevoir les parties intimes ou les sous-vêtements d’une personne que celle-ci, du fait de son habillement ou de sa présence dans un lieu clos, a caché à la vue des tiers, lorsqu’il est commis à l’insu ou sans le consentement de la personne, est puni d’un emprisonnement de deux mois à un an et d’une amende de 251 à 15 000 euros.Les faits mentionnés au premier alinéa sont punis d’un d’emprisonnement de six mois à deux ans et d’une amende de 251 à 30 000 euros :lorsqu’ils sont commis par une personne qui abuse de l’autorité que lui confèrent ses fonctions ;lorsqu’ils sont commis sur un mineur ;lorsqu’ils sont commis sur une personne dont la particulière vulnérabilité, due à son âge, à une maladie, à une infirmité, à une déficience physique ou psychique ou à un état de grossesse, est apparente ou connue de leur auteur ;lorsqu’ils sont commis par plusieurs personnes agissant en qualité d’auteur ou de complice ;lorsqu’ils sont commis dans un moyen collectif de transport de personnes ou dans un lieu destiné à l’accès à un tel moyen collectif de transport de personnes ;lorsque des images ont été fixées, enregistrées, diffusées ou transmises. »
