    Art. 1er.Par dérogation à l’article L. 234-51, alinéa 1er, du Code du travail, le salarié ayant à charge un enfant, âgé de moins de 18 ans, nécessitant en cas de maladie grave, d’accident ou d’autre raison impérieuse de santé la présence de l’un de ses parents, ne peut prétendre, pendant la durée de l’état de crise telle que fixée par la loi du 24 mars 2020 portant prorogation de l’état de crise déclaré par le règlement grand-ducal du 18 mars 2020 portant introduction d’une série de mesures dans le cadre de la lutte contre le Covid-19, au congé pour raisons familiales qu’à condition que ni le salarié demandeur, ni l’autre parent, ni un autre membre du ménage en question ne tombe sous le régime du chômage partiel prévu aux articles L. 511-1 et suivants du même Code pendant la période pour laquelle le congé est sollicité et qu’aucun autre moyen de garde ne soit disponible.
